About these terms
These terms cover your use of the MoneyEase website and the services we provide. MoneyEase is a trading style of SLWB Ltd (company number 16451543), whose registered office is at Second Floor A, Cheadle Place, Cheadle, Cheshire, England, SK8 2JX. When we say “we” or “us”, we mean SLWB Ltd.
By using our website or our services, you accept these terms. If you don’t agree with them, please don’t use our website or services. Please read them alongside our privacy policy and cookie policy.
What we do
We provide debt advice and debt solutions to people in the UK. That includes:
- a free initial assessment, to understand your financial situation
- advice on the debt solutions that suit you, including Individual Voluntary Arrangements (IVAs), Debt Management Plans (DMPs) and other options, with every option explained
- setting up and supervising formal insolvency arrangements, such as IVAs, and dealing with your creditors
Adam Southard is authorised as a Licensed Insolvency Practitioner in the United Kingdom by the Insolvency Practitioners Association. We only provide advice after completing or receiving an initial fact find where the individual(s) concerned meet the criteria for one of our insolvency solutions; therefore, all advice regarding Individual Voluntary Arrangements (IVA) is given in reasonable contemplation of an insolvency appointment.
Adam Southard is licensed to act as an Insolvency Practitioner in the UK by the Insolvency Practitioners Association. Office Holder No. 11930.
We provide solutions to individuals throughout the UK. We will help recommend solutions available to your circumstances, so you can then make an informed decision about which solution you qualify for and which is best for you.
The information on our website is general guidance, not advice about your own situation. We don’t give financial advice about investments, pensions or insurance.
Free, impartial debt advice is also available from MoneyHelper (moneyhelper.org.uk), StepChange and Citizens Advice. Where it’s right for you, we’ll point you to them.
Who can use our services
To use our services, you need to:
- be 18 or over
- live in the UK (Scotland has its own debt laws, so some solutions work differently there)
- have unsecured debts you’re struggling to repay: two or more of them, to use our form
Each debt solution has its own rules about who can use it. We’ll explain them during your initial assessment.
Your part
When you use our services, you agree to:
- give us true, complete and up-to-date information about your finances, including all your debts, income and spending
- tell us straight away if your circumstances change in a way that could affect your debt solution
- work with your adviser and our Insolvency Practitioner
- make the payments you’ve agreed, on time
- never give false or misleading information: under insolvency law, that can be a criminal offence
If you don’t, your debt solution could fail, which could have serious consequences for your finances and your credit rating.
Our part
We will:
- act in your best interests, and give you advice that suits your circumstances
- make sure your advice comes from qualified, supervised staff
- explain your options clearly, including the benefits, drawbacks and risks of each
- look after your personal information as our privacy policy explains
- follow the rules that apply to us, including those of the Insolvency Practitioners Association and the Insolvency Service
- tell you clearly about any fees before you commit to anything
Fees
Our initial assessment and advice are free. You don’t have to go ahead with anything we recommend.
If you enter an IVA, the Insolvency Practitioner is paid fees for setting it up and supervising it. These come out of your agreed monthly payments, not on top of them, and you won’t be asked to pay anything upfront before your IVA is approved.
Your IVA proposal sets out every fee in full, including the nominee’s and supervisor’s fees and any other costs, before you agree to go ahead. Your creditors must approve these fees as part of the IVA.
For any other debt solution, we’ll explain the fees in full before you agree to anything.
Our responsibility to you
We take every reasonable care to make sure our information and advice are accurate and right for you. But we can’t guarantee a particular outcome. Whether a debt solution works depends on things like your creditors agreeing to it and you keeping to its terms.
As far as the law allows, SLWB Ltd isn’t liable for any indirect or consequential loss arising from your use of our website or services. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited under English law.
Our content, and other websites
The words, design, illustrations, photos and logos on this website belong to SLWB Ltd or the people who supplied them, and are protected by copyright. You can print or save pages for your own personal use. Please don’t copy, share or change them for anything else without our written permission.
We link to other websites, such as MoneyHelper, because they may help you. We don’t control them and aren’t responsible for their content, or for any loss from using them. A link doesn’t mean we endorse a site.
Stopping or cancelling
You can stop using our website at any time. If you want to cancel a debt solution, how you do that depends on the type of solution. Your adviser will explain it.
We may suspend or limit your use of our website or services if we reasonably believe you’ve broken these terms or given us false or misleading information, or if the law or our regulators require it.
Changes, the law and contacting us
We may change these terms by updating this page. The date at the top shows when they last changed, so please check back from time to time.
These terms are governed by the law of England and Wales, and any dispute about them will be dealt with by the courts of England and Wales.
